1. Who these Terms address
Dear Guest or Cardholder:
You are in the checkout of a hotel or vacation rental (the Property) using GestaProp, owned by RAKUN VENTURES, S.A.P.I. DE C.V., tax ID RVE201126J42, Avenida de la Paz 2860-D, postal code 44130, Guadalajara, Jalisco, Mexico (Rakun Ventures). The Property has asked Rakun Ventures to collect payment on its behalf through Gesta Payments for your booking and additional services purchased on its website. Amounts paid are delivered to the Property under these Terms.
These Terms apply only when Gesta Payments processes the charge. With the Property’s own processor account, a transfer to its bank account or payment at the property, the Property receives payment directly under its own conditions.
2. Who provides each service
- The Property provides accommodation and sets prices, cancellation, refund and no-show policies and stay conditions. It alone is responsible to you for that service.
- Rakun Ventures operates the platform, receives payment on the Property’s behalf through Gesta Payments and delivers it. It does not provide accommodation or become a party to your accommodation contract.
- Stripe processes Gesta Payments charges by card, OXXO and SPEI.
3. Payment methods

You choose the payment method; the Property chooses the account that collects payment. Available methods depend on each rate plan. A deposit, when allowed by the rate plan, is collected by card only.
4. Amount, hold and confirmation
4.1 Amount. The GestaProp server calculates current rates, discounts, coupons, extras and taxes and displays a breakdown before payment. Browser data cannot change the amount. The checkout requotes when payment starts and charges the amount shown then. Amounts are in Mexican pesos unless the checkout indicates another currency.
4.2 Hold. Starting payment holds the nights for 30 minutes; unpaid holds expire and release the nights. With OXXO, the hold extends until voucher expiry. An unpaid expired voucher or SPEI reference does not confirm the booking.
4.3 Confirmation. The booking is confirmed only when the processor notifies GestaProp of an approved charge. A browser success page is insufficient. On confirmation, you receive an email with your guest-portal link.
4.4 Charge. Cards are charged when payment completes, for the total or the deposit specified by the rate plan. A rejected charge is not attempted with another processor; the checkout reports the rejection so you can use another method or card.
4.5 Descriptor. The statement descriptor depends on the processor account enabled for the Property; there is no universal descriptor here. To identify a charge, use the email confirmation reference and the contacts in §7. Separately purchased extras may create separate charges.
5. Security and payment data
The processor captures and tokenizes card details on its secure page. Neither the Property nor Rakun Ventures receives or stores the full card number or security code. Rakun Ventures retains transaction records (name, email, amount, currency, booking reference, method, charge result and any refunds or chargebacks) for accounting and tax support for at least 5 years. Their processing follows the GestaProp Privacy Notice, which explains ARCO rights.
6. Cancellations and refunds
6.1 Applicable policy. Cancellations, changes, no-shows and refunds follow the Property policy accepted at checkout. Its version, language and acceptance date and time are recorded.
6.2 Requests. Cancel or change your booking in the guest portal using the email link and a one-time code, or contact the Property directly.
6.3 Refund method. An eligible refund is authorized by the Property and returns to the original method and collecting account, never exceeding the amount actually paid. Settlement time depends on your bank or method. OXXO and SPEI refunds follow processor rules; the Property will tell you if bank-account details are needed.
6.4 Rakun Ventures does not decide refund eligibility or fund refunds itself; it executes the refund authorized by the Property under its policy.
7. Unrecognized charges and disputes
First contact the Property using the details in your confirmation email, or write to [email protected]. Rakun Ventures helps identify the transaction and refers it to the Property. You may also open a dispute or chargeback with your issuing bank. The Property is responsible for handling it; Rakun Ventures provides available booking evidence to the processor. An ongoing dispute does not suspend obligations you assumed toward the Property.
8. Liability
Rakun Ventures is responsible for correctly processing the charge you authorized and delivering it to the Property. It is not responsible for accommodation, Property policies, prices or information, or your bank’s or processor’s charge-approval decisions.
9. Amendments
Rakun Ventures may amend these Terms. The version published on gestaprop.com when you pay, identified by version number and date, applies.
10. Applicable law
These Terms follow Mexican federal law, without limiting rights under the Federal Consumer Protection Law or recourse to PROFECO. Other disputes are subject to the competent courts of Guadalajara, Jalisco.
